The 1996 U.S. Continuation-In-Part application represents an important stage in the development of the invention. The record shows a move beyond a narrowly described sports-instruction implementation toward a broader adaptive personalised information and instructional architecture capable of operating across multiple fields and through different computing arrangements.
This section preserves the principal documents associated with that development: the Continuation-In-Part application itself, the clarification that processing could occur locally or remotely, the USPTO examination issues, and the system architecture illustrated in Figure 3.
The Continuation-In-Part application identifies itself as continuing from the earlier U.S. application while adding material describing a broader range of uses and implementations. The specification extends discussion beyond sports instruction into fields including medical diagnosis, home shopping, professional design, property development, expert consultation, instructional systems and informational systems.
The application repeatedly describes personalised audio-visual instruction, personalised advice and personalised consultation. It also describes remote computers, remote databases, communications links, capture of user information, analysis of that information and return of personalised results.
Multiple forms of sensing are discussed in the 1996 Continuation-In-Part, including imaging and non-imaging approaches. This records an important development in the patent history: by this stage, the architecture was being described without dependence upon one particular sensing device.
A separate passage from the Continuation-In-Part is particularly significant because it clarifies that the computer does not have to be located remotely from the capture device. The application states that the computer may be at the same location and that the computer and associated database may be incorporated into the image-capturing means.
The term "computer" is also described broadly enough to encompass suitable forms of computing means rather than one fixed implementation.
The Continuation-In-Part encountered a significant USPTO Office Action. The examiner raised formal drafting issues, questions of definiteness, prior-art rejections and, most importantly, double-patenting concerns in relation to the earlier U.S. Patent 5,486,001.
One part of the Office Action discusses the effect of the transitional term "comprising". The examiner's reasoning treated that open-ended claim language as relevant to whether the later claims would improperly extend rights over subject matter already encompassed by the earlier patent.
The Office Action also cites prior art including Mann, McCollough, Cromarty and Gautraud et al., and records that the action was made final.
Figure 3 provides one of the clearest visual summaries of the architecture described in the Continuation-In-Part. The drawing brings together the user, image capture equipment, computer processing, storage, communications links and remote computing resources within one system.
The figure shows that information may be captured from the user, processed locally, exchanged through communications links, compared with stored information and used to generate personalised output returned to the user.
